Policies Governing Use of Premises
Warning to Skiers and Boarders
Unsafe skiing or boarding, inappropriate language or behavior; any form of disrespect shown to people or property, or failure to follow any rules will result in the loss of skiing or boarding privileges at Toggenburg.
Downhill skiing and boarding, as in other sports, contains inherent risks, including but not limited to the risk of personal injury, including catastrophic injury or death or property damage, which may be caused by variations in terrain or weather conditions or surface or subsurface snow, ice, bare spots or areas of thin cover, moguls, ruts, bumps, or other persons using the facilities; or rocks, branches, forest growth, debris, roots, stumps or other natural objects or man made objects that are incidental to the provision or maintenance of a skiing and boarding facility in New York State.
New York State law imposes a duty on you to become apprised of and understand the risks inherent in the sport of skiing and boarding, which are set forth above, so that you may make an informed decision of whether to participate in skiing and boarding notwithstanding the risks. New York also imposes additional duties upon you, which are set forth in the NYS Article 18 Safety in Skiing Code (posted around Toggenburg) to which you must adhere for the purpose of avoiding injury caused by any of the risks inherent in skiing and boarding.
If you are not willing to assume all of these risks and abide by these duties, you must not participate in skiing and boarding at this area.
Reckless Skier Policy
This policy
complies with the NYS Article 18 Safety in Skiing Code. The term "skier"
is broadly defined as anyone who uses skis, snowboard, ski boards, sled dogs, or any
other means for sliding, including tube devices, cafeteria trays, or shovels.
Reckless skiing or conduct is any of the
following:
1. Skiing at a high rate of speed without regard for personal safety or the safety of others.
(This practice is sometimes known as "bombing the slope.")
2. Skiing at a high rate of speed near lift lines or in constricted areas.
3. Causing a collision or near-miss.
4. Failure to yield to uphill skiers when entering a trail from the side.
5. Failure to exercise due caution when overtaking another skier.
6. Failure to assure that the back side of a terrain park feature is clear before use.
7. Skiing while ability is impaired by alcohol or any substance, licit or illicit.
8. Skiing on closed trails.
9. Skiing out of bounds.
10. Performing an invert (feet higher than head).
11. Building or using ramps or jumps that, in the opinion of Toggenburg staff or the Toggenburg Ski Patrol, are dangerous. (Features created or maintained by Toggenburg are exempt from this constraint.)
12. Failure to give a wide berth to an operating snow groomer or other area maintenance
equipment.
13. Swinging or bouncing chairlift chairs.
14. Riding the chairlift with the safety bar up, after a single warning.
15. Buckling a snowboard while riding a chairlift.
16. Failing to utilize a safety lanyard for a click-in snowboard-type binding. Telemark skiers must also employ safety lanyards.
17. Using skis without automatic ski brakes, or using ski poles with sharp points or without baskets.
18. Blocking an off-ramp for any of the lifts.
19. Interfering with any race in progress, or with any practice race course.
20. Skiing out of the established track of a ground tow, or bouncing the tow cable.
21. Unnecessarily blocking or impeding the normal flow of other skiers.
22. Tampering with, moving, destroying, defacing, or theft of any Toggenburg apparatus or facility.
23. Failure to adhere to posted signage, including prohibiting bringing skis, snowboards, or poles into
the lodge.
24. Commission of any criminal activity, including theft of services by not having a valid lift pass.
The Toggenburg Ski Patrol and Toggenburg staff have authority to confiscate the lift pass of any reckless skier. A confiscation decision rests on the sole judgment of such authorized person. A reckless skier can be approached at any time, and at any location within Toggenburg's area of operation, which includes the parking lots. Depending upon the circumstances, Toggenburg Ski Patrol or Toggenburg staff may issue a verbal waming of reckless conduct instead of confiscating the lift pass.
The confiscated lift pass is conveyed to Toggenburg's operating office (normally the ticket window), where Toggenburg management decides handling and final disposition of the matter. Options include, but are not limited to, suspension or revocation of Toggenburg privileges for any period of time, from minutes to days to entire seasons. Disposition is at the absolute and sole discretion of Toggenburg management, and is not appealable in any court or under any legal theory. For criminal activity, Toggenburg reserves the right to prosecute. For a tortious act, Toggenburg reserves the right to initiate a civil suit.
